- Introduction
Welcome to Moores Valley Landscapes. These Terms of Service (“Terms”) govern
your use of our website and services. By accessing our website or using our
services, you agree to be bound by these Terms.
- Services
Moores Valley Landscapes provides landscaping services including but not limited to
garden design, installation, maintenance, retaining walls, decking, paving, fencing,
and planting. The specific services provided will be outlined in a written quote or
contract.
- Quotes and Pricing
All quotes provided are valid for 30 days from the date of issue, unless otherwise
stated. Quotes are based on the information provided by you and our assessment of
the work required. Additional costs may be incurred if:
○ The scope of work changes
○ Unforeseen circumstances arise during the project
○ Materials or labor costs increase significantly between the time of quotation
and commencement of work
- Any additional costs will be discussed with you before proceeding with the work.
- Payment Terms
Unless otherwise agreed in writing, our payment terms are as follows:
○ For projects under $5,000: Full payment upon completion
○ For projects over $5,000: 50% deposit before commencement, with the
balance due upon completion
○ For larger projects: Progress payments may be arranged as specified in the
contract
- All invoices are due within 7 days of issue. Late payments may incur interest charges
at the rate of 2% per month.
- Cancellation Policy
If you wish to cancel a confirmed booking, the following cancellation fees apply:
○ More than 14 days before scheduled start date: No fee
○ 7-14 days before scheduled start date: 25% of the total quote○ Less than 7 days before scheduled start date: 50% of the total quote
○ After work has commenced: Payment for all work completed plus 50% of the
remaining quoted amount.
- Warranties
We provide a 12-month warranty on our workmanship. Plant materials are subject to
manufacturer’s or supplier’s warranties only. Proper care and maintenance are
required to maintain warranty coverage.
- Liability
Moores Valley Landscapes’s liability is limited to the value of the services provided.
We are not responsible for:
○ Damage caused by acts of nature or circumstances beyond our control
○ Damage resulting from improper maintenance after completion
○ Any consequential losses or damages
- Intellectual Property
All designs, plans, and documents created by Moores Valley Landscapes remain our
intellectual property until full payment has been received, at which point a license to
use the design for the specific project is granted.
- Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective
immediately upon posting to our website.
- Governing Law
These Terms are governed by and construed in accordance with the laws of New
Zealand. Any disputes arising from these Terms shall be subject to the exclusive
jurisdiction of the courts of New Zealand.
